TERMS AND CONDITIONS FOR THE PROVISION OF IN-PERSON SERVICES AND ELECTRONIC REGISTRATION
§1
These Terms and Conditions for the provision of electronic services are hereby established for Kliniaka BM Spółka z Ograniczoną Odpowiedzialnością, with its registered office in Będzin, ul. Niepodległości 34, 42-504 Będzin, entered in the Register of Entrepreneurs of the National Court Register under number 0001221542, NIP 6252504720, REGON 543882850-00010, entered into the register of Entities Performing Medical Activities under the number 000000303102
providing electronic services via the website www.klinikababcimarysi.pl,
email: info@cmbm.pl, telephone: +48 508 208 420, hereinafter referred to as the “Service Provider.”
The Service Provider may be contacted by email at info@cmbm.pl, by phone at +48 508 208 420, or in person at the registered office of the entity.
§2
For the purposes of these Terms and Conditions:
- Website – the Service Provider’s website available at http://cmbm.pl/ through which the Service Provider provides electronic services.
- Patient – a natural person who uses a medical appointment in the in-person office.
- Consultation – a medical appointment provided by the Service Provider to the Patient.
- Questionnaire – a personal information form containing the basic data necessary to book and conduct the Consultation.

These Terms and Conditions specify: a) the types and scope of services provided electronically,
b) the conditions for the provision of electronic services,
c) the complaint procedure regarding the provision of electronic services.
These Terms and Conditions are made available free of charge on the Website in a form allowing their acquisition, reproduction, storage, and printing. The Service Provider provides services to the Patient by means of an in-person medical consultation, carried out after prior receipt of the Questionnaire and payment via the Website.
Medical consultations offered by the Service Provider are available on the Website together with their price. The offer presented on the Website constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
In order to use the services provided by the Service Provider, it is necessary to have:
- a device equipped with a web browser and Internet access,
- an active email address.
The Patient is obliged in particular to: a) use the Website in a manner consistent with the laws applicable in the territory of the Republic of Poland and with these Terms and Conditions, including refraining from providing unlawful content and from undertaking actions that may cause disruption or damage to the Website,
b) use all content made available on the Website solely for their own personal use.
Pursuant to Article 3(1)(7) of the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2020, item 287, as amended), the provisions of that Act do not apply to healthcare services provided by healthcare professionals to patients for the purpose of assessing, maintaining, or improving their health.
§4
The Patient may book an in-person medical Consultation by completing and submitting a correctly completed Questionnaire via the Website and making payment.
The Patient is required to provide the following data in the Questionnaire:
- first and last name,
- telephone number,
- email address,
- date of birth,
- PESEL number,
- treatment status,
- description of ailments,
- information on chronic diseases,
- information on medications taken.
In addition, the Patient may attach any medical records in their possession.
Acceptance of these Terms and Conditions and the Privacy Policy is a condition for submitting the Questionnaire.
Refusal to provide the data, incorrect completion of the Questionnaire, or failure to make payment makes it impossible to conduct the in-person medical Consultation.
After the completion of the actions necessary to conduct the Consultation, the Service Provider shall contact the Patient by telephone within 48 hours in order to inform them of the nearest available Consultation date.
The date of the In-Person Visit may be changed or cancelled by the Patient with at least 24 hours’ notice. Changes should be reported by phone at +48 508 208 420 or by email to info@cmbm.pl.
The Service Provider confirms the change of date of the In-Person Visit or its cancellation by sending the Patient an SMS or email.
If the Patient fails to cancel the date of the In-Person Visit and does not attend, the fee paid shall not be refunded.
A refund of the fee or rescheduling of the In-Person Visit may take place only if the Patient demonstrates that they were unable to attend the In-Person Visit at the scheduled time due to extraordinary circumstances beyond their control.
The date of the In-Person Visit may be cancelled by the Service Provider with at least 24 hours’ notice. In such a case, the Service Provider contacts the Patient and proposes a new date.
If the new date is not accepted, the Service Provider shall refund the fee.
The Service Provider may also postpone the time of the Consultation, informing the Patient by telephone or email and proposing a new date. If the Patient does not accept the new date, a full refund shall be made.
§5
The prices of services are given in Polish zloty (PLN).
A condition for conducting the Consultation is prior payment via the payment system on the website or in person at Centrum Medyczne BM before the visit.
Payment details appear after the Questionnaire has been submitted.
Payment is deemed made at the moment it is credited to the Service Provider’s bank account.
Payment confirmation is sent to the Patient’s email address.
§6
Consultations are conducted by a family medicine specialist.
The Consultation takes the form of an in-person visit, and its duration is determined by the doctor.
During the Consultation, the Patient may obtain:
- medical advice,
- diagnosis,
- therapeutic recommendations,
- an e-prescription,
- information on treatment and prevention.
An e-prescription is issued in accordance with applicable law and made available through www.pacjent.gov.pl.
The Patient is obliged to provide truthful data.
The Service Provider provides information exclusively to the Patient and does not conduct general consultations.
§7
The Patient may report irregularities in the functioning of the Website.
Complaints should be submitted to:

A complaint must include:
- the Patient’s details,
- the reason for the complaint,
- the requested remedy.
Complaints are considered within 14 days.
The Patient is informed of the outcome by email or by post.
§8
The consumer has the right to out-of-court dispute resolution, including in particular: a) submitting a request to a permanent amicable consumer court,
b) seeking assistance from a consumer ombudsman or a social organization.

§9
In matters not regulated herein, the provisions of the Polish Civil Code and consumer laws shall apply.
Disputes with a Patient who is not a consumer shall be resolved by the court having jurisdiction over the registered office of the Service Provider.
These Terms and Conditions shall enter into force on 3 February 2026.
